Terms of Service

1. Acceptance of Terms By accessing funlifemedia.co or engaging our services, you agree to be bound by these Terms of Service. These terms apply to all clients, visitors, and others who access our "Visual Architecture" services, including production, strategy, and digital development.

2. Professional Services & Collaboration Fun Life Media operates as a creative partnership. While Keagan and Hendrik lead the production, we reserve the right to engage third-party specialists (Stylists, MUA, Lighting Technicians) to meet the specific requirements of a project brief.

3. Intellectual Property & Usage Rights

  • Ownership: Unless otherwise agreed upon in a signed commercial contract, Fun Life Media retains the copyright to all raw footage, unedited stills, and working files.

  • Client License: Upon full payment, the client is granted a non-exclusive, perpetual license to use the final delivered assets (stills and motion) for the marketing and promotional purposes specified in the project brief.

  • Portfolio Rights: Fun Life Media reserves the right to use any captured content, behind-the-scenes footage, and final assets for our own promotional purposes (portfolio, social media, and "The Studio" page) unless a formal Non-Disclosure Agreement (NDA) is in place.

4. Growth Strategy & Ad Management Clients engaging us for Meta and Google Ads management understand that ad spend is paid directly to the respective platforms (Meta/Google). Fun Life Media is responsible for the strategy, creative implementation, and optimization, but cannot guarantee specific viral results or third-party platform uptime.

5. Client Obligations To achieve "Visual Architecture" standards, the client must provide timely feedback and necessary brand assets. Delays in communication of more than 14 days may result in project suspension or a re-initiation fee.

6. Payment Terms All services require a [INSERT %] non-refundable retainer to secure production dates. Final high-resolution assets and "Growth" handovers will only be released once the remaining balance is settled in full.

7. Limitation of Liability Fun Life Media is not liable for any indirect, incidental, or consequential damages resulting from the use of our creative assets or digital strategies. We provide professional-grade Sony, Fujifilm, and DJI equipment to ensure the highest quality, but are not responsible for technical failures of third-party hosting or social media platforms.

8. Governing Law These terms are governed by and construed in accordance with the laws of South Africa. Any disputes relating to these terms will be subject to the exclusive jurisdiction of the courts in Cape Town.

9. Modifications We reserve the right to update these terms at any time. Continued use of our services following any changes constitutes acceptance of the new terms.
